Last week, nuclear electricity producer Energoatom won a case in the Kiev Economic Court against the National Energy Company of Ukraine (NERC). Energoatom complained that the NERC exceeded its mandate by setting tariffs for the nuclear plant. However, the NERC has filed an appeal against the court?s decision. Now, the case will be heard by an appellate economic court. Concorde Capital: NERC sets tariffs and controls the use of money by all Oblenergos, and Energoatom as well. This is done to prevent an unjustified increase of tariffs and take advantage of the company?s monopoly position. The decision by the Kiev Economic Court could create a precedent for Obloenergos to challenge the NERC as well.
